What a Revocable Living Trust Does

A revocable living trust is a legal arrangement in which you, as the grantor, transfer assets into a trust, name a trustee to manage them, and designate beneficiaries to receive them. In most cases, you serve as your own initial trustee, keeping full control over your property during your lifetime. Because the trust is revocable, you can amend its terms, change beneficiaries, or revoke it entirely at any time, as long as you remain mentally competent.

A living trust takes effect immediately upon signing and funding, which is a meaningful distinction from a will that has no legal effect until death. Most comprehensive estate plans pair a revocable living trust with a pour-over will (which directs any assets not already in the trust to flow into it at death), along with powers of attorney and healthcare directives.

Avoiding Probate & Planning for Incapacity

Assets properly titled in a revocable living trust don’t pass through the El Paso County probate court under the Fourth Judicial District Court. Beneficiaries can receive assets without court supervision, without the delays probate can bring, and without the distribution terms becoming a public record the way a will does.

Incapacity Planning Through a Successor Trustee

A revocable living trust also addresses what happens if you become unable to manage your own affairs. If incapacity occurs, your named successor trustee can step in immediately to manage trust assets, without the need for a court-appointed conservatorship. That protection is something a will alone can’t provide. One critical step: the trust must be funded. Retitling assets such as real estate, bank accounts, and investment accounts into the trust’s name is what can make probate avoidance possible.
