Court-Ordered & Voluntary Mediation in Colorado
Colorado trial courts have authority under the Colorado Dispute Resolution Act to order mediation in family law cases, and they exercise it regularly, particularly where children are involved. Under C.R.S. § 13-22-311, a court may not refer a case to mediation where a party claims to have been the victim of physical or psychological abuse by the other party and states an unwillingness to participate. A party may also object to a mediation referral within five days by demonstrating compelling reasons, which may include that the cost of mediation would exceed the relief sought or that prior attempts to resolve the issues were unsuccessful. When court-ordered mediation is completed, the mediator provides the court with a written statement certifying that the parties have met, unless counsel for a party is required to do so by local rule or court order.
Parties don’t have to wait for a court order. Voluntary mediation is available at any point in a family law case, and many parenting plans and separation agreements already require it for future disputes before either party can file a motion. Even partial agreements have real value: they narrow the contested issues, reducing the cost and conflict of any remaining litigation.
