Colorado trial courts have authority under the Colorado Dispute Resolution Act to order mediation in family law cases, and they exercise it regularly, particularly where children are involved. Under C.R.S. § 13-22-311, a court may not refer a case to mediation where a party claims to have been the victim of physical or psychological abuse by the other party and states an unwillingness to participate. A party may also object to a mediation referral within five days by demonstrating compelling reasons, which may include that the cost of mediation would exceed the relief sought or that prior attempts to resolve the issues were unsuccessful. When court-ordered mediation is completed, the mediator provides the court with a written statement certifying that the parties have met, unless counsel for a party is required to do so by local rule or court order.

Parties don’t have to wait for a court order. Voluntary mediation is available at any point in a family law case, and many parenting plans and separation agreements already require it for future disputes before either party can file a motion. Even partial agreements have real value: they narrow the contested issues, reducing the cost and conflict of any remaining litigation.

How Family Law Mediation Sessions Work

Sessions can take place in person or remotely, depending on the parties’ preferences and circumstances. A session may involve joint discussions with both parties present, private caucuses where the mediator meets separately with each side, or a combination of both formats. Some matters resolve in a single session; others require multiple meetings scheduled at the parties’ convenience. Throughout, the mediator facilitates discussion and helps parties explore options without imposing decisions or favoring either side.

When agreement is reached, the mediator drafts a Memorandum of Understanding (MOU). The parties then work with their respective attorneys to finalize a formal parenting plan or separation agreement for submission to the court.

Mediation vs. Litigation in Family Law

Mediation generally offers greater flexibility, lower cost, shorter timelines, and more privacy than contested litigation. It works well when both parties are willing to engage in good faith and communicate openly. Litigation may be the more appropriate path when one party won’t participate meaningfully, when safety concerns or coercive dynamics are present, when financial matters require court-supervised discovery, or when an immediate court order is needed.

Parties who don’t reach full agreement in mediation aren’t foreclosed from litigating remaining issues. Any partial agreements can still be submitted to the court, narrowing what’s left for a contested hearing.

Allocation of Parental Responsibilities & Parenting Time

Colorado uses the term “allocation of parental responsibilities” (APR) to describe what many other states call child custody. APR covers both decision-making authority for education, healthcare, and extracurricular activities, and parenting time schedules. Mediation allows parents to craft a parenting plan that reflects their family’s actual circumstances, including school schedules, holiday arrangements, and protocols for resolving future disagreements, rather than accepting a court-imposed schedule.

Any parenting plan reached through mediation must be consistent with the child’s best interests standard that Colorado courts apply. Plans developed through mediation can often be more detailed and adaptable than orders entered after contested litigation.

Child Support & Spousal Maintenance in Mediation

Child support in Colorado is calculated using a statutory formula that accounts for both parents’ incomes, the number of overnight stays, and certain expenses. The formula establishes a baseline; parties may agree to different terms in limited circumstances. Spousal maintenance guidelines in Colorado are advisory rather than mandatory, which makes maintenance well suited to negotiation between the parties during mediation.

Full financial disclosure from both parties is a foundation of any productive mediation involving support or property issues. A mediator can provide general information about how courts approach support calculations, though they don’t provide legal advice to either side.

Post-Decree Modifications Through Mediation

Family circumstances change after a divorce or custody order is entered. A job change, relocation, or shift in a child’s needs can prompt one or both parties to seek a modification. Mediation is a common way to work through those disputes before returning to court, and many existing orders specifically require parties to attempt mediation before filing a motion.

A successful post-decree mediation can result in a modified parenting plan, adjusted support obligation, or other agreed changes submitted to the court for approval, often at lower cost and with less conflict than contested modification proceedings.

Confidentiality in Colorado Family Law Mediation

Colorado’s Dispute Resolution Act (C.R.S. § 13-22-301 et seq.) provides broad statutory confidentiality protections for what parties say and disclose during mediation. With limited exceptions for threats of harm or mandatory reporting obligations, mediation communications generally can’t be used as evidence in court. The mediator can’t be called as a witness to testify about what occurred in sessions (C.R.S. § 13-22-307).

These protections are designed to encourage candid problem solving. Parties can explore options and make concessions during mediation without concern that those statements will be used against them if the case later proceeds to litigation.

When Mediation May Not Be the Right Approach

Mediation isn’t the right fit for every situation. Active domestic violence, coercive control dynamics, or cases involving protection orders may make it unsuitable without additional safeguards, and courts may decline to order it in those circumstances. When financial matters involve concealed assets or complex business valuations, litigation tools such as formal discovery may be necessary. Significant power imbalances between parties can also undermine the process.

If mediation doesn’t result in agreement, the case proceeds through the standard court process. Nothing disclosed or discussed during mediation can be used against either party in those proceedings.

Preparing for Family Law Mediation

Gathering complete financial information before sessions helps the process move efficiently: income records, account statements, property valuations, and expense documentation. Identifying your priorities and areas of flexibility in advance allows mediation time to focus on genuinely contested issues rather than working through basic facts.
