A postnuptial agreement (called a marital agreement under Colorado law) is a written contract signed by spouses who intend to remain married. It defines financial rights and responsibilities, can protect assets, and may reduce the potential for contentious litigation if the marriage later dissolves. Unlike a prenuptial agreement, a postnup is available only after marriage and takes effect immediately upon signing.

What Colorado Law Says About Postnuptial Agreements

Under C.R.S. § 14-2-302(2), a postnuptial agreement is defined as an agreement between spouses who intend to remain married, which affirms, modifies, or waives a marital right or obligation during the marriage, at legal separation, at dissolution, upon the death of a spouse, or upon another specified event. That intent to remain married is a key legal distinction: if spouses are contemplating divorce when they sign, the document becomes a separation agreement under Colorado law, not a postnuptial agreement.

Colorado doesn’t provide a standard state form for postnuptial agreements. DIY templates frequently fail to meet the requirements of the Colorado Uniform Premarital and Marital Agreements Act (UPMAA), which creates real enforceability risk if the agreement is ever presented to a court.

Why Colorado Springs Couples Pursue Postnuptial Agreements

There’s no single profile of a couple that seeks a postnup. The triggering circumstances vary widely.

Common reasons include:

• Business formation or significant income change: When one spouse starts a business or experiences a substantial shift in earnings, formalizing financial arrangements can protect both parties.
• One spouse leaving the workforce: A postnup can address financial security for a spouse who steps away from a career to raise children.
• Blended families: Couples with children from prior relationships may use a postnup to protect assets intended for those children.
• No prenuptial agreement was signed: A postnup can establish the financial clarity that wasn’t addressed before the wedding.
• Reconciliation: Some couples enter a postnup as part of rebuilding trust after infidelity or financial misconduct.
• Military family planning: Servicemembers stationed at Fort Carson, Peterson Space Force Base, or Schriever Space Force Base may use postnuptial agreements to address financial arrangements around deployments, relocations, and military retirement pay.

UPMAA Enforceability Requirements in Colorado

For a postnuptial agreement to be enforceable under the Colorado UPMAA, it must satisfy the conditions under the statute. The Fourth Judicial District Court serving El Paso and Teller Counties handles family law matters for Colorado Springs residents.

The five required conditions:

• The agreement must be in writing
• Both spouses must sign it
• Both parties must execute it voluntarily
• Each spouse must provide full and fair financial disclosure, covering property, liabilities, and income
• Each party must have had reasonable access to independent legal representation (and if one spouse can’t afford counsel, the represented spouse may be required to pay for independent counsel)

Colorado courts won’t enforce postnuptial agreement terms governing child custody or child support. Those matters remain under court jurisdiction and are determined based on the child’s best interests at the time of any proceeding. Spousal maintenance provisions must also not be unconscionable at the time of enforcement, even if they seemed reasonable when drafted.
