How Colorado is Empowering Paralegals to Provide Divorce Solutions
Beginning June 1, 2024, a new Colorado law will allow paralegals to provide divorce solutions, creating a notable shift in the legal field. Traditionally, only licensed attorneys could handle divorce proceedings. This legislation enables paralegals, who are trained to support lawyers, to offer similar services. With this legal change, the Colorado Supreme Court has granted licensed legal paraprofessionals (LLPs) the right to represent clients in specific scenarios. Paralegals working as LLPs are permitted to support clients in a wide range of legal services. However, they are not allowed to present oral arguments or cross-examine witnesses. With this initiative, the Colorado Supreme Court hopes to boost the accessibility and affordability of legal representation.
What Legal Services Can Colorado LLPs Provide?
As LLPs become more commonplace in the legal arena, clients can determine how to approach legal services for certain legal matters. The new rule associated with this change, Rule 207.1(2)(g), has expanded the scope of tasks an LLP can undertake beyond traditional boundaries.
In Colorado, LLPs have the authority to:
- Establish contractual relationships with clients.
- Conduct client interviews.
- Guide clients on using Colorado's standard court forms and pleadings.
- Fill out standard forms.
- Explain and submit documents that support the standard court forms.
- Manage the filing and service of documents.
- Review and explain pleadings from the opposing party or those related to pension plans.
- Act as a client's representative during negotiations, including mediation.
- Draft and submit settlement agreements.
- Facilitate communication with the opposing party or attorney regarding documents.
- Maintain consistent communication with the client.
- Clarify court orders for clients.
- Offer clients information about supplemental resources.
- Advise clients to seek legal representation for more complex issues that arise.
- Have limited court involvement, which could include providing emotional support, communicating with the client during proceedings, answering questions from the court, addressing the court when called upon, taking notes, and assisting the client in understanding the proceedings and applicable orders.
This decision is intended to bridge the representation gap, particularly in cases that involve limited marital assets, establishing parentage, and determining the allocation of parental responsibility (APR). This expansion of responsibilities allows LLPs to offer a broader array of services, facilitating access to legal assistance for more people and situations.
It's important to note that while LLPs can undertake these tasks, they do not possess all the capabilities of a lawyer. For more complex legal issues, it is advisable to seek full legal representation.
